Supreme Court Revives Anti-Money Laundering Law

In a surprising move, the Supreme Court has brought back a federal law aimed at cracking down on money laundering, drug trafficking, and terrorism. The Corporate Transparency Act, which requires businesses to share details about their owners, had been temporarily blocked by a federal judge who called it an overreach of Congress’s power.

The court’s decision, made without explanation, is a temporary fix while legal challenges against the law continue. Critics argue that the law is too demanding, especially for small businesses like family trusts and homeowners’ associations. They claim it’s not only a hassle but also a threat to privacy and states’ rights.

The law, passed in 2021, has faced pushback from a mix of groups, including a firearms dealer, a tech company, and even the Libertarian Party of Mississippi. They argue that Congress doesn’t have the authority under the Constitution’s commerce clause to regulate what they see as “inaction” rather than actual economic activity.

Supporters, however, say the law is crucial for preventing illegal activities by making it harder for shady businesses to hide behind anonymous ownership. The debate is far from over, but for now, the law is back in effect, leaving businesses scrambling to comply.
