Prosecutors Move to Drop Classified Documents Case Against Trump’s Co-Defendants

Federal prosecutors are asking to drop their case against two co-defendants tied to Donald Trump’s classified documents scandal. This move could officially close the chapter on a legal saga that accused Trump of holding onto sensitive materials after leaving the White House.

The prosecutors filed a one-page request with a federal appeals court in Atlanta, asking them to dismiss an appeal to reinstate charges against Walt Nauta and Carlos De Oliveira. The two were charged alongside Trump, accused of helping him obstruct efforts to retrieve classified documents in 2021.

This case has been winding through the courts since last summer when Judge Aileen M. Cannon, a Trump appointee, tossed out the charges entirely. Her decision, which went against long-standing legal precedent, claimed that special counsel Jack Smith was unlawfully appointed.

While prosecutors initially challenged Cannon’s ruling, they dropped their appeal against Trump after he was re-elected in November. A Justice Department policy bars prosecuting a sitting president. However, the appeals against Nauta and De Oliveira lingered until now.

If the appeals court agrees, it would mark the formal end of this high-profile legal battle, which has been closely watched since it began.
